AN extensive report on whether or not the death of a murdered infant discovered in 1973 warrants a renewed investigation has been presented to the minister for justice by senior counsel Patrick Gageby.
Following the conclusion of an inquest into the death of infant Noleen Murphy in February, the then minster for justice Michael McDowell appointed Gageby to review her death "on the basis of all the available papers on what is known in relation to the case and the garda investigation to see if the public interest requires the matter to be taken further".
The infant's mother, Cynthia Owen, has claimed she gave birth to the infant in the family home in Dalkey following repeated sexual abuse.
The Department of Justice confirmed to the Sunday Tribune yesterday that Gageby has completed his report and its findings were now being considered by the minister, Brian Lenihan. A spokesman for Lenihan said he was considering the report and would issue a statement on it in the near future. "Its findings will be published and the minister will comment on the findings at that stage, " he added.
Last February, an inquest jury unanimously found that the baby, whose body was discovered in a laneway in Dun Laoghaire, was Owen's child.
A judicial review of coroner Dr Kieran Geraghty's findings, taken by Owen's father and three of her sisters, is currently before the High Court.
The four are challenging the coroner's findings that Owen is the mother of the infant.
