The Supreme Court has reserved judgement until Tuesday in the appeal by ACC against a High Court decision to allow lawyers for the Liam Carroll controlled Zoe Group to make a fresh examinership bid last month. Lawyers for ACC argued that the group could not have a second, third or fourth bite of the cherry and there must be finality to litigation. They also accused the Zoe Group of abuse of process stating that there had been a deliberate decision to withhold information in the first application for examinership. Lawyers for the Zoe Group said that when Liam Carroll made the decision to withhold information against legal advice there was no doubt this was affected by his ill health. They said that real people wanted the companies to survive. The court will deliver its ruling on Tuesday.
