ACC has been awarded all of its costs in its long-running legal battle against the Liam Carroll-controlled Zoe Group. The legal fees are expected to amount to well over €1m for Zoe. Last week, the three-judge Supreme Court made orders confirming the liquidation of key companies in the group. The court ruled that the companies must bear the consequences of Mr Carroll's decision to deliberately withhold material and crucial evidence from the courts when the group made its first examinership bid in July, which was rejected. It found that the conscious and strategic decision to withhold the companies' business plan back then was an abuse of the court's process. It also held that there had been references to Mr Carroll's health at the time, but added that there was no evidence of medical reasons which could be taken into account. ACC is owed €136m by the Zoe Group and had always opposed court protection being granted.
